Naples City employees, starting with the city attorney, must remind the Athens Group to keep their original promise to permanently preserve and protect the existing 18-hole golf course and tennis center. The citizens of Naples recently made it clear that this is what they expect.
Here’s why.
Documents approved for the Naples Beach Hotel and Golf Club by a previous city council in 2019 include a Master Site Plan covering 104.6 acres. All 18-hole of the existing Jack Nicklaus design, championship golf course is shown, including every tee, fairway, putting green, sand trap, practice area and lake, as well as a field club with six tennis courts, all of which are permitted uses in the recreational and open space district .
An ALTA / NSPS Land Title Survey was also submitted by the Athens Group and approved in 2019. Here, too, the same uses are shown as in the Master Site Plan.
Both are legally valid documents that are valid on the 104.6 hectares of the PLANNED DEVELOPMENT DOCUMENT FOR NEAPLES BEACH CLUB RESIDENCES AND GOLF COURSE Regulation 19-R6. It was approved by the city council in 2019.
In order to provide even more certainty that regulation 19-R6 is in force, the site plan 19-SP18 was presented by Erica Martin, interim planning director, during a staff presentation at the public hearing of the city council on March 25th. It shows all of the same uses of the Master Site Plan and ALTA Land Title Survey on the same 104.6 acres. The approved master site plan is just as enforceable as all other requirements of regulation 19-R6 outlined by it, such as building dimensions, heights, recesses and lengths up to the height of final monuments at entrance monuments.
Without further action by the current city council, all uses that are part of City Ordinance 19-R6 must be retained by the Athens Group “as is”. Any revision of the approved site plan 19-SP18 is restricted to these uses by the City Code. These uses, like any other property in Naples, must be kept in normal operating condition.
The Athens Group would need to provide a revised site plan if they wanted to make changes to Site Plan 19-SP18. For example, a note in the sales brochure distributed by the Athens Group. It shows a 10-hole golf course on approximately 70 acres of the 104.6 acres. Are 70 hectares a coincidence or did Athens ask golf course designer Tom Fazio to design a course on 70 hectares?
The approved planned development and indefinite easement specifies that “at least seventy (70) acres of the concession area remain in open space”. This entitles the city to a reduction in the premium for flood insurance. However, no maximum acres are set, and the entire existing 104.6 hectares of the golf course will also qualify.
Therefore, a city council is allowed to preserve 104.6 hectares that have already been approved in Site Plan 19-SP18. As provided in regulation 2019-14330, permanent easement, according to paragraph 5, enforcement by the city: “The city can at any time request the enforcement of the easement according to paragraph 6, notification of default.”

The Athens Marketing Department continues to publish a sales brochure showing a 10-hole golf course on 70 hectares. Athens must forego a 10-hole golf course plan and keep its original promises. Athens should cease pursuit of trendy, fashionable sports activities and hold on to traditions, especially here in southwest Florida. Golf and tennis are age-old games, with athletic skills that have developed over the course of life, whether beginner or advanced. These are individual tests that do not require these two games to be reinvented.
If Athens comes up with a site plan for something less than the current 104.6 hectare Jack Nicklaus championship golf course, the city council should reject it.
