MIAMI – A nurse who pleaded guilty to six charges on threats to kill Vice President Kamala Harris was sentenced to 12 months and one day in prison Tuesday in federal court.
Niviane Petit Phelps, 39, has been in prison for around seven months. Attorney Scott Saul, who represented Phelps, said the former Jackson Memorial Hospital nurse was a victim of domestic violence and her mental health suffered.
“He was physically abusive, very manipulative. She took every penny she earned and sent it to his superintendent, ”Saul said. “I definitely think he filled her head with ideas.”
Phelps admitted that she sent 30-second video clips to her husband, who was in jail, in February. The videos showed Phelps shouting swear words and saying that she accepted $ 53,000 to carry out the “hit” against Harris within 50 days. Phelps also sent a photo of herself holding a firearm.

Two days after the videos and photos were sent, Phelps applied for a concealed weapon permit.
“I think if she was really dangerous she would have taken other steps to get things done,” Saul said, adding, “You go 39 years without being arrested. You keep a job for 20 years. You are raising three children. She is on her own. It’s like what I said in court, she deserves redemption. ”
After her release, she will be on parole. The extra day in their sentencing allows for regular mental health assessments.
